19. No Confidential or Privileged Relationship

This license does not transfer ownership of your original intellectual property.

24. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT, IF ANY, PAID DIRECTLY BY THE CLAIMANT TO ONISION WIKI DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
  • ONE HUNDRED UNITED STATES DOLLARS.

These limitations apply regardless of the theory of liability and even if the possibility of damages was disclosed.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

25. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Onision Wiki, Onision, its administrators, contributors, contractors, service providers, and affiliated persons from claims, liabilities, damages, judgments, losses, expenses, and reasonable legal fees arising from or relating to:

  • Your unlawful use of the Site
  • Your violation of these Terms
  • Material you submit
  • Your infringement of another person's rights
  • Your harassment or targeting of another person
  • Your unauthorized republication or alteration of Site content
  • Your false representation of affiliation with the Site
  • Your violation of a court order, contract, protective order, or legal duty
  • Your attempt to gain unauthorized access to the Site
  • Your use of Site material in a false, deceptive, or unlawful manner

This obligation does not require indemnification for conduct that applicable law prohibits from being indemnified.

26. Reservation of Rights

Onision Wiki reserves all rights and defenses available under constitutional, statutory, common, and equitable law.

Failure to enforce a provision on one occasion does not waive the right to enforce it later.

27. Governing Law

To the fullest extent permitted by law, these Terms and disputes arising from the operation or use of Onision Wiki shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Any legal action not subject to a separately enforceable dispute-resolution agreement shall be brought in a court of competent jurisdiction located in Pierce County, Washington, or in the United States District Court for the Western District of Washington when federal jurisdiction exists.

You consent to personal jurisdiction and venue in those courts to the fullest extent permitted by applicable law.

This section does not prevent Onision Wiki from seeking emergency or injunctive relief in another court when reasonably necessary to protect the Site, evidence, security, intellectual property, or legal rights.

28. International Use

Onision Wiki is operated from the United States.

The Site does not represent that all content is appropriate, lawful, or available in every jurisdiction.

Persons accessing the Site from another location do so on their own initiative and are responsible for compliance with applicable local law.

29. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable where possible.

The remaining provisions shall continue in effect.

30. No Waiver

Failure or delay in exercising a right under these Terms does not waive that right.

A waiver is effective only if made expressly and in writing by an authorized representative of Onision Wiki.

31. Changes to These Terms

Onision Wiki may revise these Terms as the Site develops, features change, or legal requirements evolve.
